The United States Surgeon General has determined that involuntary inhalation of tobacco smoke (a) is a cause of numerous diseases in healthy nonsmokers; (b) is a major contributor to indoor air pollution; and (c) is harmful to children, elderly people, individuals with cardiovascular and/or respiratory diseases.
Accordingly, the purpose of this Regulation is to (1) protect the public health and welfare by prohibiting smoking in enclosed public places. (2) regulate smoking at the place of employment; and (3) recognize that where the need to breathe smoke-free air conflicts with the desire to smoke, the need to breathe smoke-free air shall have priority.
This regulation bans smoking in most places that are frequented by the public. This includes 100% of restaurant seating, grocery stores, convenience stores, waiting rooms and other enclosed public places. The effective date of this regulation is July 30, 2007.
